Are Court Records Public in Hunterdon County?
Most court records in Hunterdon County are presumptively open to public inspection under New Jersey Court Rule 1:38, which governs public access to both court records and administrative records of the judiciary. This rule covers documents filed in civil, criminal, family, and municipal court proceedings.
Rule 1:38 also identifies specific categories of records that are excluded from public access. The following types of records are confidential or restricted in Hunterdon County:
- Juvenile delinquency records — Protected to safeguard the privacy of minors
- Adoption records — Sealed under N.J.S.A. 9:3-51 and 9:3-52; accessible only by court order
- Child abuse and neglect records — Restricted to case parties and authorized personnel
- Domestic violence records — Certain filings may be restricted or sealed to protect victims
- Records sealed by court order — A judge may seal any record when disclosure could harm parties or compromise an investigation
- Grand jury proceedings — Not available to the public
- Medical records — Classified as confidential in eCourts filings (effective after January 1, 2023, per amendments to Rule 1:38-3)
- Presentence investigation reports — Not publicly accessible
Even when records are publicly available, personal identifiers must be redacted before filing. Under Rule 1:38-7, filers are prohibited from including full Social Security numbers, financial account numbers, and certain personal contact details in public court filings. Attorneys and self-represented litigants share responsibility for these redactions.
Individuals denied access to records they believe should be public may challenge the denial through procedures outlined in New Jersey’s Open Public Records Act (OPRA). For court-held records specifically, Rule 1:38 governs access rather than OPRA, although OPRA applies to records held by county offices such as the Prosecutor’s Office or Sheriff’s Office.
